What is the New Amendment in MVA?
The new amendment in the Central Motor Vehicles Rules 1989 makes the transfer of vehicle ownership to another person after the death of its actual owner. According to recent reports the Central Government has updated the existing Motor Vehicle Act making the process of transferring the ownership to another person or driven by another person due to the owner's death. As an impact of the new amendment the vehicle owner will be able to nominate a person of choice as a nominee in the vehicle registration certificate. This will make the process of transferring the ownership to another person easier.
The name of the nominee will be based on the information provided in the bank accounts and finance related documents of the original owner. The owner of the vehicle can refer the name of the nominee at the time of vehicle registration. The name of the nominee can also be mentioned later online by filing an application along with the identity proof of the nominee. To claim the ownership of the vehicle the nominee will have to present the death certificate of the original owner in front of the associated authorities.
The new amendment has come after the problems faced by the public for transferring the registration of the vehicle after the death of the original owner. The process of transferring the ownership earlier was quite complex. The rules further introduced by the local RTO authorities made the process more difficult.
